  • Voluntary termination help!

    Hello,

    I am after some advice regarding my car.

    I purchased a vehicle from Startline Motor Finance in December 2015 on a HP agreement.
    We fell behind with some arrears around a year ago when I went on maternity leave but those were cleared shortly after.

    After researching last week what options we had, we decided to go down the voluntary termination route and used a template from this site. They have since rang me to say that I am unable to do this because when I had the arrears they terminated my agreement. I had absolutely no idea I have had no paperwork. They said they sent out the letter in April 2017 but I haven’t received this. I keep and file everything, I am extremely organised! But I don’t have this letter. They’ve never mentioned it to me on the phone either, till now.
    I asked what replaced my original agreement then as I assume I need to be in one, but they said nothing so as it stands I’m not in any agreement with them but I still have and am paying for the car. They advised that therefore, there is no agreement to terminate and I can’t give back the car, I must voluntary surrender the car. I asked why I have been paying for a car for a further year that you terminated and she then told me that in April 2017 Head office decided to carry on my agreement out of good faith as I came to a payment plan to clear the arrears. So I said that the agreement was still in place then and therefore I can terminate and all I got was a simple “No.”

    I don’t know whether they can do what they have said they can do, whether I’m being fobbed off or if I have any rights to continue with the voluntary termination?

    Any advice would be gratefully received. Thank you!

      I would suggest that you make a subject access request for all information that they hold about you. You can do this now but will cost you £10 but if you wait until after 25 May next month, new data protection laws come into play meaning its free, and they have to comply within one month rather than 40 days.
