  • Faster payment paid into old account.

    Hi, I`ve joined the forum as I need some advice of a payment I received into the wrong account...

    A few years ago I was the director of a limited company, The company folded with some debt and was dissolved by companies house a few years ago.. The bank account however was with barclays for some reason it remained open with about £2000 of debt.

    Previously another company I did work for paid me into this account, but after my company folded I went self employed and opened an account as a sole trader with Santander.

    I`ve been back with the company doing work again a few times and gave them my new account details.. and have wrote clearly on the invoice the new details also. They had been using the new account to pay my but my most recent payment they sent to the Barclays account which I have just found out has remained open.. Its cleared some of the overdraft but I`m just wondering can I ask them to refund the payment into the account as the company technically no longer exists?

    And lastly where do I stand with the company that paid me into the wrong account. Is it up to them to try and get it back or is this something I need to do...

    Nightmare start to the weekend :-/

    Yes, you have a right to be paid, if you can prove you provided the invoice with the correct details, it is the company's fault and they would have to recover the amount themselves. They could claim it back via restitution but would need to have informed the bank of the error although the bank itself may have a defence. Anyway your answer is yes you can.

      Thanks for your help Rob, Yes the invoice definitely has the correct details on it.

      Hopefully they can get it back somehow, Just hope they pay me in the mean time and I don`t have to wait until they actually get it back :-/

        No you shouldn't have to wait to get it back, did you specify any payment terms on the invoice? if so, they should pay within that time or if the time has lapsed and you've only just noticed it should be reasonable time i.e. 7-14 days. I would suggest pointing out if they don't already know that they have incorrectly paid to the wrong account and you still require payment.
