    Hi guys,
    To cut a long story short one of my staff walked out of work yesterday.
    Our customer/staff policy is no socialising etc due to complications that can arise.A guy in the cafe kept asking this girl to go out for a meal with him which is against company rules because of what has exactly happened.
    So i am now Ł1200 a year worse off!! I understand employees have rights but is there some right for an employer where a member of staff breaks our rules,costs us money,and leaves us in the lurch!!
    Can I withold any pay or sue for any loss of earnings???

    Could you please explain how you calculated the figure of Ł1,200?

    To sum it up, it all depends on the contract. If your employee was on a zero hour contract, I would advise that there's not much you can do.

    Normally, a week's notice would be required which would increase up to twelve weeks on a week per year basis.

    In reality, taking action against a former employee in a case like this is not advised.

      Why are you Ł1200 a year worse off if he has just walked out??

      What was his contract of employment?

      And no you cannot withold his pay

        It looks like your no socialising policy backfired. Did she walk out because your policy didn't allow her to go out with the guy in question? It's not clear whether the guy in the cafe is also your employee or a customer. :noidea:

        You can't withhold pay, if you do they can issue a claim for unpaid wages either at the employment tribunal or county court.

        How long did she work for you? Walking out of a job is usually discouraged because employers can say that's what they did to anyone asking for a reference and it wouldn't do them any favours, however, if she was only with you for a short time then she may just not mention having worked for you.

        I assume the cafe is still open so where is the loss of earnings coming from? :confuse2:

          The only difference is what is below the waist, they used to use that to justify the pay disparage between men and women at one time.

          Not to mention the law as written is always in the Male characteristic, even to this day

          We have a lot of growing up to do

          I will stop waffling now

            In most cases I wouldn't bother to ask since, as you say, gender makes no practical difference for most legal purposes, however, in this case I just wondered whether I'd got it all backwards, the OP didn't make it very clear whether a female employee ran off with a male customer or vice versa, and the whole issue seems to centre around relationships at work (or lack thereof). IMHO, banning them often has the opposite effect. When people are attracted to each other, they are often ready to give up their family and even a sizable inheritance, let alone a job, and somehow not being allowed to date at work makes it even more tempting, if you see what I mean.

              In Finnish language there is only one word for he/she "hän" which covers both genders.

                Often, the question arises whether payment of a discretionary? whether the employee has resigned, or has been dismissed. There are certain factors that need to be considered here.
