Ehhh, why are you wanting to sue them. You can't just sue them because they supplied you or your business with goods you purchased from them, unless said goods were either not as described or not fit for purpose, in which case your entitled to return them to the supplier.

You need to tell us exactly whats gone on to make you feel like suing them?

To be able to sue, there would have to be some sort of contract between the parties for the supply of goods and a breach of that contract, for example, if they failed to supply the goods by a certain date, they didn't supply the amount or number of units stated, they supplied the wrong goods or they were not as described.

Litigation should be the last resort though, and the parties should attempt to resolve the dispute before taking legal action. Without knowing the details I'm just shooting in the dark here. If, for example, the shop had organised a special event and the supplier failed to deliver the goods in time for that event, leaving the shop without goods to sell, then that could be a reason to sue. If the goods are not as described, are of poor quality, etc., I'd say the first step would be to return the goods to the supplier and ask for a replacement. We really need to know what's going on to be able to comment further.

But why would you want to sue the supplier? Was their a breach of contract, where the items not the items the shop ordered, where they not as described, where they faulty? You have to give us details for us to tell you whether you have grounds to sue the supplier.

Your asking us on what grounds a shop can sue a supplier, well we can't answer that without knowing what the dispute between the shop and the supplier actually is. You can not sue just because the supplier supplied the shop with homemade items, unless they were described as not being homemade, which is unlikely.

unless of course it's you that is the supplier ... in that case, you would be well advised to ensure that the shop in question has no reason to sue you (as per FP's and Teaboy's posts)
