My friend was in partnership with a friend of his.
The company is a Limited company, but my friend is not a director. But he has many, many documents and emails to confirm they are in business together. The director friend confirms this in emails and writing. My friend invested £20,000 via the business account.
Now, the director friend tries to close the company, and refuses to show the business bank accounts to my friend. The HMRC has objected to the company being wound up, so the company has not been wound up. My friend thinks that is because of bounce back loans and such like during the covid era. I asked the County court what form does he need to apply to the county court to make his business partner/friend disclose the bank statements.
Go see a solicitor was the reply. Also, if he aporoaches HMRC to ask if they have given bounce back loans to his business/friend, they will want proof that he is a business partner which he can prove with all the docuentation and bank transfers etc. But, once he proves he is a business partner and has a right to know if bounce back loans have been given. Then he is worried that he will also become liable for the bounce back loans as well.
so, any and all advice on the above and bounce back loans and court application forms greatly wellcome. Cheers in advance.
