    Hi,

    I am having an extension built. The cost will be around £50,000.

    I had a quote from a builder and was happy with the quote. The quote was on his Limited Company headed paper.

    When I made my first payment installment (around £3000) he asked that the payment goes into his wife's personal account - his wife is a director of his limited company. I did do that.

    I have a larger payment now coming up (£7000). He again wants me to pay the money into his wife's personal account. I am a bit reluctant now to do this.

    He has not signed any paperwork - only paperwork I have seen is on the quote which was on had his limited company letterhead.

    I think the best way forward for me is to ask him whether he wants to do the work as a Limited Company or as a sole trader. If he wants Limited Company, then payment to go into the Limited Company account. If sole trader, then I can put money into his wife's account.

    On the paperwork that was filled for the council, it does say the name of his Limited Company.

    Please can someone advise whether my thinking is correct?

    Also, could I have got myself in a pickle if I have - as requested - paid into his wife's account if he wants to go down the Limited Company route?

    Just in case anyone is wondering why I didn't sort all this out before he started working, I thought it was the Limited Company I was dealing with. I only started to wonder when he asked for payment into a personal account.

    Ask for a receipt that is on Ltd company paper.

    If the quotation was on Ltd company paper, and that is the only paperwork that you received, and you accepted the quotation then it is likely that is the basis of the contract, so your contract is with the Ltd company.

      If the company is heading for bankruptcy and you continue paying into a personal account, the official receiver seeing a contract on the company books that hasn't been paid, may chase you, as a debtor, for the money
