New to the forum, hope this is the right place to ask.
I run a bespoke furniture company - we make TV units, wardrobes, cupboards, cabinets, chests of drawers etc to order and deliver around the country.
To help save costs (we pass the savings onto the customer!) we send one man and a van to deliver - we offer free delivery but ask that the customer has an able-bodied person on site to assist the driver with unloading (boxes can be heavy!)
My question is in 3 parts:
1. If the customer injured themselves whilst carrying the furniture (slipping, hurting their back etc) would we be liable?
2. If the delivery driver injured themselves as a result of the customer not handling the goods correctly, would we be breaching some Health & Safety regulations?
It's important for me that our employees and customers are safe and don't come to any harm, but it's vital to the success of our business model that our costs are low because that's what helps us win business from places like IKEA etc... we can do bespoke stuff at the same price as their generic off-the-shelf furniture.
Part 3. If the customer is helping and drops the goods and damages them, are we liable to replace the broken parts? Do we need to give them a waiver to sign?
