  • O2 CPW ignoring credit limit

    i have 2 phones with O2 CPW
    1 is daughters and is on a 18 month contract,now with daughter being 15 she is always going over her minutes/texts.so we have had a 10 pound credit limit put on and this has been in place for years.we have on-line billing so we can keep check of the bills.i understand that the 10 pound limit is 3 days behind and can often be more than 10 pound before the phone is barred for the month.have never had a problem with this.
    however since april we have recieved bills for 114, 108, 276, 274, 306 all unbeknown to us.i know that sounds stupid but the phone was never barred and the online billing never shown the account being over and it always stated that there was a 10 pound credit limit on.it was only by chance that we actually looked at a bank statement and spotted the 306 pound bill.
    after contacting 02 CPW and dealing with a manager who said that the bar was lifted in april for some reason and it must of been on my request (is he nuts? shes 15 ) he said he would look at it as all calls are recorded.anyway he gets back to me and said that the april call is missing.
    he also stated that legally my daughter shouldnt be having the phone on contract because she was under 18,even though its in my name.also it would be blatantly obvious that the call credit limit was over due to the sheer volume of the calls(totally agree with that).anyway to resolve it i agreed to share the blunt of the blame and he agreed to refund the last bill (306 pound)
    a cheque would arrive for 306 pound within 28 days ..well it never so i rang again only to be told that the finace department would not authorise the cheque without the managers take /reasoning on it.the manager was on holiday and so i rang again and despite being sent e-mails to contact me he has not done so.the bills have caused great finical hardship which have incurred us going over our overdraft and therefore paying hefty sums in bank charges and interest.
    i know that its mine and my daughters responibilty to a great extent but how do i get this 306 pound off them? am really narked with them now for refusing to pay out
    any advice?

    Send the Subject Access Request letter that is in the library.
