  • JD Williams Debts

    A DCA Lowell have purchased 4 accounts in my name from JD Williams group. I was challenging these because I was and are still in an IVA. Affordability checks were not carried out by the creditor which would have shown my IVA. Can I challlenge these debts or if not negotiate FFS? The debts total just over£1000 I wonder how much they paid for them?

    These are catalogue debts which you took out whilst you were in the IVA? Did you have written permission from your supervisor to take these debts out? If not you have breached the terms of your IVA.

    It is irrelevant what Lowell's paid for the debts.

    You have also posted before that you have payday loans where you don't want the correspondence coming to your address. Were these also taken out whilst you were in the IVA? Have you repaid these?

      If you took on debts while still subject to an IVA it could be considered fraudulent and your IVA is breached
      My guess is this will catch up with you.
      It beggars belief an IVA is a chance to get things on an even keel

        I suspect many IPs would be prepared to turn a blind eye if you settle these debts in full and say you won't take on any more. But if you now try to challenge these debts I doubt whether your IP will feel that you have been behaving reasonably.

          I find that this site is very rude to people looking for advice only to be told off for getting in to difficulties!

              Cannot see how anybody has been rude to you! only comments made regarding certain actions you may have taken when under certain circumstances it may/would seem inappropriate to do so?
