Re: peterpiper v UK Services & Support Passport - DEFENCE DUE BEFORE Monday, April 6,

Looks like UKSSP have failed to file the directions questionnaire and been given another 7 days to do so. This has all the makings of the CEL/DEAL fiasco in private parking. If the case is struck out would an application for costs because of unreasonable behaviour of the claimant be in order?

Ive googled but cant find any reference to a CEL/DEAL fiasco in private parking. Can I ask (purely out of interest) what that refers to?

          Regards

          Pete

I think ostell is referring to the private parking companies whose tactics are to issue claims for non payment of parking fines in an attempt to intimidate people into settling but when it comes down to have no intention of following through and actually having the case heard in court, which could well be the same tactic employed by BPS.

Sorry. Yes people that DEAL attempted to take to court (private parking) then didn't turn up or cancelled at the last moment have been ordered to pay costs to the defendant because of unreasonable behaviour. About £200 seems to be the favourite amount.

              This is one of them

Ok so hearing listed for 13 August which means your witness statement needs to be filed by 30 July.

Have a look at the other witness statements defendants have already filed to get an idea.

Interestingly the witness statement doesn't include the usual list of emails and texts sent to the victim (sorry Customer)

Rest of the exhibits are pretty normal crud, screenshots of his website with bits underlined etc.

This is the two usual HMPO letters, the list of overdue charges and the letter from the ASA confirming the review is being undertaken. (no result of that STILL - possibly next Wednesday)
