  • RLP - Primark / Please Help!

    Hi LBers

We have committed a really nonsense mistake and feel really helpless and hating myself at the same time.

Me and my partner went on shopping in Primark last month, she tried to steal two pieces of clothes worth around £17.00 retail value. Security guard caught us when we are making our way out to the store. We,then, called in back room of the store and questioned (no police were called). My partner did this even I stopped her to do it!

My partner have said truth, apologized and accepted what she did. But guard have taken copy of MY driving license and my partners bank statement. And then guard took our pictures too. We have not sign anything but guard advised that our records will be on CRB report for five years.
We returned the clothes back to the guard.

Last week we both have received a letters from RLP. Each letter demanding £174.50 as a fine for what we did. We are really ashamed and scared and don't want to speak to anyone else on this problem as the nature of the act. This was the very first time(and last) she tried to steal and she got caught.

Please can you advise us what to do on this? Pay the fine or ignore the letters as I have read about RLP on internet and most says ignore the letter as they have no power to take anyone in court if one don't pay the fine.
My concern is if We do not pay the fine can not they (Primark) use CCTV recording against us as a proof and take us to the court? Also is it correct that our name will be appear on CRB checks even there were no police involved?

Please could someone advise us what to do as this is really affecting our day to day life and jobs, we know that this is a really stupid what we done and now seared that will not do anything like this in our entire life.

    Kind Regards

Re: RLP - Primark / Please Help!

      Hi All

Today i received second letter from RLP, i am worried now tbh.
By looking at it it has so many legal terms which i dont even get it clearly.

Is someone on this forum was in the same situation and has ignored these letters?
i would like to know if these people can take any legal action against me which can damage our credit file or can rlp send any debt recovery at home?

Please can someone advise as really confused and scared.

      Thanks in advance.

You might care to read about this case

Basically they cannot claim against you. You may care to quote that case to RLP if you write but better just to ignore.

RLP cannot FINE anyone it is an INVOICE, ignore them, but come back to this thread if you get more threats.

Re: RLP - Primark / Please Help!

Without any police involvement there is no possibility of this incident appearing on any CRB check - a store security guard simply does not have the power to do that.

Re: RLP - Primark / Please Help!

              Thanks All for your reply.

Its been long time I nearly forgot this and suddenly recieved letter this morning from BPO Collection agency. This letter looks scary and never thought RLP will hand over this case to collection agency.

Letter states something like '' ...Could you please contact within 7 days, failing which you are at risk of our client issuing proceedings against you, which will incur further liability by way of the additional court fees, interest and legal cost.
A court Judgement , which remains unsatisfied after 30 days, may also affect your credit rating,''

Can someone advise if BPO can come my house for collections or they will action as they states above??
I have read a lot about BPO collections agency and i think they take actions which result people with CCJ ect. Is there anyone on site gone through as same as us, please could you share your experience and let us know the outcome.

Thanks all again for providing great help on this site.

Re: RLP - Primark / Please Help!

Just had a look for others with letters from BPO - I can't see the attachment on this thread but see if it is the same and looks like you will get a further letter from RLP again after this. http://www.consumeractiongroup.co.uk...=1#post4348332 They have a bigger forum area for RLP issues so having a read about on there might assist you decide what to do with it.

Found someone else with a BPO letter - is this like the one you have? Have a read of the rest of that thread too - they sent a very brief letter back and BPO sent the ''' debt''' back to RLP.
                  The thread is http://www.consumeractiongroup.co.uk...wed-help/page4

                      Hey
basically a couple of years ago when I was under 18 I got shoplifting (stupid idea i know) they took me at the back of the room and they called the police, the police did not come but when i was going through the door to go out the police came but the security did not say something they just let me go but the police officers went in. The store photocopied one document of mine before letting me go home and a couple of weeks after I received a fine not from the police like £50 which i paid but will that appear to my dbs or other criminal record? Because as i was leaving the police was coming in the store so basically I didn’t meet them or talk with them.

                        Hi and welcome
You have nothing to worry about as you have no criminal record, have not received a caution or any "official" notification.

pity you paid the invoice (don't give their demands the status of a fine!)

but I’m scared that maybe when the police went to their office they might have taken my details even though I wasn’t there? I don’t know, i did not receive anything from the police department just that fine from the company
