    Outcome; No contact and Debt sold to Lowell

    Lowell , we had Moorcroft, Westcroft etc etc chase us, I refused to acknowledge any correspondence considering the fraudulent action taken and ignored by Creation Finance. A fraudulent signature is not acceptable on a credit agrrement ? If so no contract ?

    Out of the blue a letter a couple of weeks ago from Fredrickson, numerous phone calls , late at night , text messages daily to my husbands phone and a call to his place of work.
    Then this weekend a letter from Bryan Carter with the famous June 24th date I have noticed on other members threads. Legal action may be taken etc.....
    I have all copies of my correspondence up untill the Oct 2nd 2007 and response from C.F.
    My husband has two default cases on his credit record, one from C.F. and the other from Lowell 2010.
    Is this statue barred now or not ?
    If yes, how can I get these bad credits removed ?
    I intend to send a S.B. to Byan Carter, Fredrickson and Lowell.
    Any adivse by any of you in the know would be gratefully appreciated. Thank You

                I see you've got your letters out, just remember to keep an eye on the timescales. :clock:

                If you are sure it's SBd, then you can just submit a SBd defence when the time comes, even without the documents. This is just procedure. :thumb:

                Do post up when you hear from them (or not, as it's more likely to be the case knowing the parties involved).

                    The court won't write to you at this stage. Presumably you sent the CCA request to Lowell and CPR request to BC. They are supposed to respond, in theory Lowell should respond in 14 working days and BC in 7 days. but I'd say you have a better chance of winning the lotto than of getting any documents from either of them. :flypig: :flypig:

                    There's no need to chase the CCA request but once the 7 days are up, you'll have to contact BC. Having said that, none of the documents requested would prove that the debt is SBd as such, the idea is to follow the process and have a sort of back-up plan in case this turned out not to be SBd.

                    I know this is all very confusing. The paperwork won't show that the debt is SBd as I said above. You have a total of 33 days from date on claim to submit your defence. If you are sure it's SBd then you can just go on and submit a SBd defence. If you do, the onus would be on THEM to PROVE it isn't. :thumb:

                    Once you submit a defence, the court will send a copy to BC who will have 28 days to respond saying whether they wish to proceed with the claim or not. It's only after that happens when you will expect to hear from the court. :ranger:

                      Thank you once again. The debt was from 2006 july (12 month intrest free) period till July 2007. Payments were ever made as the documentation was tampered with . This debt was sold to Lowell in 2010 23.06. We only engaged in correspondence 2007 with land of leather and creation consumer finance to advise them of the credit agreement that had been rewritten and fraudlently signed ..... no payments ever taken as the account on the fraudulent document was not the original account that payments were to be made but the credit card deposit . The bank did not pay a penny out of this account. I have kept all correspondence . I presume this to be SB .... ??? :tinysmile_grin_t:
