  • complaint upheld

    Baliffs said they had been to my house twice but there was no evidence of this. After they investigated I have received a letter where they admit that they went to the wrong house therefore putting my details through someone elses door who lives close by have they breached any rights that i may have!!!

    They have certainly broken your right to privacy.

    They are also not due any fees for their mistaken "visits".

    Which bunch of buffoons was involved and why were they seeking payment?

      Breach of the data protection act to be more precise CC. Go get them AT1

      Make a complaint the the Information Commissioners office and send photocopies of their written admission on liability, you will get some compo and they will get a fine lol.

              The right to privacy brings the Human Rights Act into play. Although it applies, mainly, to central and local government, it also applies to private-sector companies carrying out functions on behalf of central or local government, which is what this bunch of brain-dead idiots were doing, carrying out an enforcement function on behalf of a local authority. Another stick to beat the bailiff with.

                  How about a letter to the bailiff company, please MR bailiff you should not post my details to an unrelated third party, and I have reported you to the ICO, who may award damages against you and a fine, which if not paid may lead to bailiff action to recover the monies from you!

                    As many of you guys know, I was brought up in Eton.
                    (Or was it 'eaten & brought up'?; damn this old age! :tinysmile_cry_t

                    Anyway, much as I relish the opportunity to have a pop at bullies, I find myself reluctantly agreeing with labman.

                    Civil Procedure Rules are pretty clear on 'behaving reasonably'; I for one wouldn't like to fall foul of that if I was hauled into court.

                    But that, as they say, is just my opinion.

                      What is at all "unreasonable" about someone other than the complainant saying that they believed it possible that the bailiff might somehow have suffered from a severe impairment of his higher cognitive functions?

                              After looking at the behaviours and mannerisms of Naughton & Wayne, I have to say that how these bailiffs act just isn't cricket! Many act like the base scoundrels they are, whilst others actually follow the rules.
