  • Dodgey Notice of Assignments?

    Hi All

    Could you give your opinions on these Notice of Assignements which both claim to be the original copy - but are obviously different.

    This first one was sent to me By HFO who have now made a claim against us. The NOA is dated early 2008. I thought this was odd as we never recieved one untill just prior to the issue of the court claim. So we issued the OC with an SAR.

    Here is copy sent by HFO.

    After sending Welcome the SAR, and further follow ups threatening legal action, they finaly sent us this Copy of the NOA. Which they state is the Original. ( I have a recorded phone call with a welcome employee telling me they actually got this from HFO).

    I also have evidnce from welcome that they did not have our address at that time as we had moved - so how did they send us that NOA - and how did HFO send it us>

    Is this something i can use in my defence - to be frank i think they have just made this up for the court.

    Here is the welcome copy - as you can see its different to the HFO copy.

    Just came across this thread - how did you get on with this? Is it still ongoing, as I know from experience that these claims can really drag on? We are in a similar situation to you. HFO routinely send out NoAs which supposedly originate from the original creditor, but are actually sent by HFO (apparently with the OCs permission). I have noticed that all of the NoA are exactly the same wording, although they supposedly originate from different creditors, i.e., M&S, Barclays, Welcome, etc.

    Hope you got a good result if this has already concluded.

          Still going on - at trial stage but already had one full day. Our Barrister ook apart HFO's evidence almost line by line.

          The NOA is faked - and have some other very dodgey looking paperwork.

          HFO did not have a CCL at the time of assignment - so have broke the law.

          The whole case is fraudulant - but they won't give up - even after the judge at first hearing saying they may wish to consider their position.

          Arrogant fools.

          OFT have got vey detailed complaint and have taken statements - I am now considering taking it to the Police.

              how did the barrister prove the noa was fake and not from the original oc.

              its just i have received one from crappyquest stating the oc sent it and i know crappyquest reconstructed it

                It was us that found out it was fake.

                Iniially sent an SAR to the OC - who obviously failed to provide a copy of the noa as they had never originaly sent it.

                After many letters and phone calls, finaly threatening legal action , trying to get the OC to either produce the noa - or confirm it was not from them - the OC panicked and sent us an NOA. Problem was it was different to the one we wa sent by the DCA.

                After questioning this, it turns out that the noa sent by the OC was provided to them by the DCA, and they had never sent one at all.

                There are other docs that have "appeard" mid litigation. The whole thing is a conspiracey between the OC to provide the DCA with virtualy anything they want.

                As soon as we are out of litigation it's off to the Police. OFT have already got a detailed statement from us - and are very interested in the case.

                If i was you - put pressure on the OC to provide a copy of the noa, if it is alleged they originaly sent it.
