  • PRA account managers and full investigation...

    Hi everyone! I'm new here and I have PRA Group on my case!
    I owe £1,300 to a Halifax credit card and was paying it off ok (was originally nearer £2,000), but fell into financial difficulties a year ago as I'm freelance and the bottom has fallen out of my industry. Looking for more/different work now, but one of the casualties of this difficult period has been the Halifax debt.

    It's been bought by PRA and just now I received an "account managers will now start full investigation" letter.

    I know the Halifax has written off the debt and these bottom feeders have bought it for, say, £130. What's my next move?

    Hi RM & welcome to LB.
    Have you received a Notice of Assignment from Halifax or PRA (or possibly both)?

    I received an "account managers will now start full investigation" letter.
    Does this require a response (other than 'pay us now') or is there a definite threat of litigation? ('Will', as opposed to 'may')

      Hi! Thanks for your response.
      I've had the notice of assignment from both Halifax and PRA.

      However, the letter today says the investigation will include some or all of:
      looking at credit file
      assessing home ownership
      financial circumstances

      Then, apparently, they'll decide how best to proceed, so no explicit legal threat.

        Send a s.77-79 CCA Request to PRA.

        When did you open this Halifax credit card account and how?

        Did you have PPI?

            You could SAR Halifax for details.
            Keep all correspondence in writing, keep copies & get proof of posting.

                    Ok, I've completely neglected this issue (partner working abroad for a couple of weeks so I'm holding the fort here...) and now I've had the letter before claim.
                    I have to respond before May 25 - is it too late to send the CCA request?

                        Ok - I'm worried about the £1 fee postal order though - will they see it as a payment towards, and therefore an acknowledgment of, the debt?

                              Well, there'd be the (virtual) paper trail with the email and I guess I could send the postal order separately.

                              But if you think it's a no-goer, I'll send a physical letter.
