  • The Court messed up!!

    Hi… I hope there is someone who can help me, please...

    I was in a dispute with a neighbour which went to court and I was unsuccessful and was left with substantial legal costs to pay.

    To cut a (very) long story short, there was to be a hearing for a Charging Order to be made final, and I entered a defence and counterclaim.

    Due to a mistake by the court, which stated that I had failed to pay the court fee, (I am exempt and had provided the necessary documents by way of proof), my counterclaim was not issued to the court and the Judge found against me.

    After a whole year of trying to get answers from the court, I finally received an email yesterday, where the court admitted they had made a mistake and apologised.

    I now need to try and sort out what to do next… I was denied a fair hearing due to the court's maladministration, and need to make an application for my claim against the judgment creditor to be heard.

    I believe I need to make an application for the Charging Order to be set aside.

      Can you say some more about your defence and counterclaim? Are you just trying to re-litigate the original case - that is not likely to succeed.
