    The claimant has 28 days to respond to your defence form the date they receive a copy from the court.

    If they don't respond within that limit the court will stay the claim, please note you Will Not be informed
    if this happens, so just after the 28 days expires you need to phone the court and check to see if the claim
    is stayed.

      Received a letter from Cabot today. Letter reads...

      Please find enclosed all the relevant information following your request for information under section (77-78) of the consumer credit act 1974.

      We consider the agreement is now enforceable and therefore we are entitled to obtain a county court judgement against you. However, we would prefer that you work with us to set up a repayment plan to settle your outstanding balance.

      The outstanding balance is £xxx.xx. Please make contact as soon as possible to discuss the options available to you in order to settle this account.

      There is another letter which reads.....

      Dear Miss xxxxxxx

      " statement of account"

      This statement is prepared in compliance with section 78 of the consumer credit act 1974.

      At the date of this letter Cabot confirms that:
      • your account has an outstanding balance of £xxx.xx
      •the amount you are required to pay to Cabot is £xxx.xx
      •you are not able to draw further on this account.

      Existing payment arrangements

      Where you have an existing repayment arrangement with us, we shall continue to honour and regularly review this unless you miss your payments. Please note that the repayment arrangement does not affect, modify or vary the original terms of the credit agreement, we have just relaxed them to assist you with your current financial circumstances.

      They have also enclosed a signed agreement by myself dated 02/06/2007.

      What do I do now??

                      Not that I can recall. If I had then surely they would have provided this. But I really don't remember. I definitely have not revived or paid anything in the last 2 years for definate! As for the 4 years before that j wouldn't know
