    As when I phoned the solicitor they told have until 4 Nov to respond or they will have judgement entered against me. Only phoned solicitors up to see the situation as never had a court claim before. And was told I have until 4 Nov to respond. And that they could not discuss anything further with me. I have not sent no paper work back yet as not clear what to fill out. As now been told the debt is too old for them to chase. Am going to my bank to check statements on when last payment went out to original creditors

      You need to acknowledge the claim online via MCOL ... that gives you extra time to put in a defence!!
      Debt is like any other trap, easy enough to get into, but hard enough to get out of.

      It doesn't matter where your journey begins, so long as you begin it...

          The Solicitor would know nothing about the Debt and if its a legal claim or is Statute Barred who are they?

            Acknowledging the county court claim is different to acknowledging the debt.

            To allow you time to sort out your defence you must acknowledge the claim within 14 days of receipt. There should be instructions on the front bottom right of the form to log into MCOL and indicate your intention to defend the claim.

            Once you have done that you can ask for more information from the claimant - and inform them you will be defending the claim on the basis that any debt is statute barred.

              I have contacted bank they have to send statements via post as cannot access that far back online. The solicitors are Wright Hassell

                you need to go onto Money Claim Online asap to acknowledge the CLAIM (this doesn't mean you are acknowledging the debt). There will be a code on the claim form that you need to enter in on MCOL. This will give you 33 days from the date of issue on the claim form in which to put in a defence.

                • Tick 'defend in full' but do not put anything in the defence box yet.
                • Make a note of your MCOL password (you'll need it later).


                Then you need to send off a CCA request to the claimant - http://www.legalbeagles.info/forums/...y-of-Agreement (enclosing a postal order for the statutory fee)
                and a CPR request to the claimant's solicitor (Wright Hassel) - http://www.legalbeagles.info/forums/...ic-information.

                None of these actions means you are acknowledging the debt ... but you need to get the claim acknowledged within 14 days of the date on the claim form or they will just apply for a default judgement :sad:

                      Have acknowledged the claim. Clicked on the AOS section. Hope that was right one. Did this on Sunday and have not yet heard anything back from the court to say they are allowing me 28 days to defend my case. Also have sent off relevant letter on Monday first class signed for. Do I slap let the solicitors know that this debt is statue barred.

                        You won't have anything back from the court, although you should have had a confirmation of the AOS when you submitted it.... you just need to keep an eye on dates and put your defence in before it is due.

                        The defence is due 28 days after you received it ( or 33 after the issue date printed on the claim form)

                            I am ins similar situation as well. And its Caboot finance. I have been sent a CCJ form yesterday demanding pay back 8 years. Just wondering if you managed to get things resolved after the acknowledgement.

                              Hi sorry for late reply but not been on site. But as far as I know if your debt is older than 6 years it is statue barred which means they cannot chase you for it. But you need to make sure it is that old. Ask one of this sites leagal team on what to do
