  • Contract change

I started employment with this company 3 months ago. The contract states that overtime payments were as detailed in one of the clauses and would be paid at the appropriate rate dependent on what day and time the overtime was worked. On receiving my pay, I found that the overtime was at basic rate. I have taken up this matter with my manager who told me that I had received the wrong contract and that it would be changed. I would not have taken the job if I had known this as overtime is a big part of my average working month. Where do I stand?

    Re: Contract change

Hello and welcome to the forum.
Since you only started working 3 months ago, your rights are very limited.
Is there a clause in the contract you were given that states overtime would be paid at more than basic rate?
It's poor administration to now claim that you were given the wrong contract, but I'd ask them to pay for the overtime already worked at the rate stated on the contract you received.
Going forward, you'll have to decide whether you want to stay there.
They are entitled to ask you to work reasonable overtime, but they would then probably only pay for that at basic rate.

Was the "wrong contract" signed by your employer?
