    So basically no one has any idea what the judgment will be, but the judges were seemingly concerned with the upset caused if PE couldn't charge penalties rather than the legality of them charging them ?

    So 4 to 6 weeks till judgment....

            The finding of fact that they are penalties is not up for challenge. The case is about commercial justification. Don't forget that.

              How can their pre-estimate of loss be that they will lose the income they get from penalties though?

                Well it depends whether you mean the ppc or the landholder. The landholder can lose because the turnover of customers is lower but the ppc can only have a loss in a pay and display. Moloney is confused as he held that PE were the principal and as such there can never be an actual loss.

                  Prankster mentioned about the argument being that the loss would be that PE might lose the contract to run the car park if they didn't collect the £85's. Which makes no sense at all to me because if there weren't the £85's they wouldn't be needed to issue them in the first place.

                  The argument that parking would be chaos otherwise is just a lie too. Of the thousands of Parking tickets issues how many are for major issues ( can't really think of any - parking across two spaces ? leaving the car there for a whole day ? ) and how many are for staying a few minutes too long?

                        The court of appeal is off for Easter and have not issued a judgement as of yet. Not even a draft.
