  • ParkingEye Claim - Notice os Allocation to the Small Claims Track - Nogotiations?

    Hi

    I have received a parking ticket from PE a while ago. My advice at the time was to ignore it, along with the following letters which would threaten court action.
    I heard nothing for months; then the court claim arrived. I filed my defence and I have now received a Notice of Allocation to the Small Claims Court (Hearing). My initial idea was that I wanted to defend my case in full. However, due to a change in personal circumstances, I now wish to negotiate an out of court settlement with them. The Notice of Allocation letter mentions a Mediation Service. It states that I must respond within 7 days if I want to use the Mediation Service. If I wish to negotiate with ParkingEye, do I need to use this Mediation Service, or do I contact ParkingEye myself to start the negotiations?

    Any help would be greatly appreciated.

    Tom and Thomas. Start low and don't settle for more than £50. £20 has worked once, i believe, but i guess it depends how good a defence you put in.

      I've been advised that, because I overstayed in a free car park by 20mins, that I should offer as little as £3 (cost of their initial letter), is this good advice?

        They won't accept it but it won't do you any harm.

          I don't expect them to, but I just didn't want to be making a fool of myself offering a ridiculous amount to start with.

          I've contacted the mediation service and will start the negotiating through them.

            There's nothing to stop you dealing directly with PE. As has been said start off very low.

            You need to say that you will defend the claim in full to give you 28 days to prepare a defence and stop PE winning by default. You can change your mind. The mediation service takes some time to arrange.
