    hi all what we would like to knowis, are constructive dismissal claims different for a shareholder/director/employee relating to a sexual discrimination and equality act claim. Theoretically, if ,i as a shareholder had shares worth £100,000 and were forced to quit my position and walk away from the shares would i receive the £100,000 in my compensation if i were to win my constructive dismissal claim.

    I think you need to elaborate more before you can get any advice, so can you please tell the whole story.

      IF you were to win, and that is a HUGE if, because such claims have the lowest win rate of any claim - less than 3% - a tribunal would only consider those matters relating to the employment. Anything else would have to be a civil claim.

      The odds are that if you walk away, you walk away with absolutely nothing, with the possible exception of a large legal bill. With those odds, and with that much at stake, you shouldn't be on any free website. You should be at the office of an employment specialist solicitor.

          Possibly not. I didn't realise who the OP was until later. But when I did realise, I also figured out that it wouldn't be worth saying more. The OP is set on a course that will rip the family apart, probably bankrupt the business with multiple legal fees - I wouldn't lay bets on what those shares will be worth. And they will almost certainly end up with nothing. But they've been told that twice. If they are still here, then get a lawyer is the only advice left.

          At least someone will benefit from all this. The lawyers.
