i researched other threads to get this, but it looks there's a 1 [i] missing

the claim shall be struck out without further order of the court, and

Not if you apply in time. Also ask for their consent to the order before you file it, if you have time. (a consent order)

Thanks for your help.
I need to read up on consent. I dont think there will be time to get that dusted before I have to file a defence.
Given that drydens have advised they won't seek judgement, should I still file a defence? Its currently due Thursday (18th).

I wouldn't file a defence unless absolutely necessary. An unless order should stop a default judgement but there is a risk doing it at the last minute that everything gets out of synch. It would normally need them to ask for it and they have said they won't but .......

hi, i filed my defense and there was no response from the claimant so the case was stayed a couple of days ago.

is the next step to apply for the case to be struck out?

it seems to be plodding along rather slowly at the moment.
the claimant failed to file a response to my defense and i called the bulk centre who confirmed it had been stayed, but a week later i received an allocation questionnaire. i filled out and sent back about 6 weeks ago, have not heard anything since.
