I moved out of the studio flat over 4 years ago where I had lived for 9 months. The rent at that time was inclusive of all bills. Unfortunately it wasn't stated on the agreement. It is later confirmed by the estate agent that it was inclusive of all bills via email. By the end of Nov' last year, I received the council tax demand and said it has been handed to the JBW.
The argument is that
- the landlord refused to pay because the property was re-valued 3 months after I moved and the council sent the bill for extra charge with the back dated. He therefore refused it.
- I refused it because my rent was inclusive of it. The revaluation and the property prices up or down are not in my interest.
When I first contacted the council they said the agreement didn't say it was inclusive and so who occupy the property has to pay the bill. Eventually the estates agent confirmed me via email
""The tenant claims he is not liable to pay the outstanding amount as his agreement with his landlord was with council tax included in his rent. The landlord has confirmed this but has told me there was a change to the council tax bands after the tenant moved out, but this was back dated to the dates the tenant was in the property. So the increase in council tax came after the tenant left the property but was back dated to a period were he was a tenant in the property."""
Although I included this email in my appeal, it was unsuccessful. My 2nd appeal to the council's Appeal Tribunal is in process. But the bailiff made the first visit and dropped the letter with additional charge that amounted to more than the council demand.
I called JBW to hold but asked to pay within 24 hours that has now passed. Any advice please?
