    Received letter from Blake Lapthorn yesterday.
    Roughly saying they are requesting copies of CA,terms & conditions and statements from their client,
    Copies will be provided once they have been received.

    They also say the POC,s have sufficient info for me to respond to the claim.
    also if I beleive i have a defence i must file by relevant date. (Already done)

    In the absence of a Defence, our client has instructed us to request judgement.
    Any questions or wish to discuss this matter please phone *** (yeh right)

    How can Solicitors start a claim without the relevant info in the first place ?
    Does this mean some solicitors are no better than the debt collectors for not having the true facts ?

        Also remember that when starting a case either the solicitors or company representative has to sign the form so it is possible that whoever signed has committed perjury

            Firstly, you need to check who signed the claim form - solicitors or company rep. As long as you had already filed your defence "at present can't acknowledge or deny due to lack of information, etc..." I would keep this stick for later, but YES, you can use it when necessary, there have been legal precedents based on this point.

              How long does it take to receive allocation questionaire if this is the next step ?

                How long is a piece of string (I know, half as much as from the centre to the end). There response to your defence should be next (can't remember, 14 days for this???). In any case unless you hear anything very soon you may have to write a letter to Arrow Global giving them 48 hours to respond otherwise you will be making an application to court for a strike out.

                  i have similar problems with MrsJ

                  I owe MBNA just over £3000 (card was taken out in around 2004) and because of my financial problems from 2010 i havent been able to pay. they have then passed the debt onto arrow.

                  PS i have lots of other debts which could possibly go the same way but gonna sort this one first as it hase gone to a ccj.

                  today 17/12/12 i have sent a copy of CPR 31.14 request (via 1st class recorded delivery) to SHOOSMITHS who are the acting solicitor for Arrow. I also logged that i would be defending the claim on moneyclaim.gov.uk.

                  Could some 1 please advise of my next actions and the dates on which i should have a responce by?

                  Also when should i log my defence online??

                  many thanks in advance?

                    the issue from northampton county court was 7/12/12 but didnt want it leave it much longer as i legally had until the 21 correct??
