  • CB Vs Lowells Group

    Well I'm at a slight loose end, so time for some payback.
    Now Lowells, in their various guises, have been a right pain to me so time for some payback.

    They have already had around £200 off me from my Cap1 claim in 2007 and I'm sure I've paid them other moneys before I "woke up".

    So Lowell Group comprises:

    • Lowell Portfolio 1 - the debt buying arm
    • Lowell Financial - 1st level DCA
    • RED debt - slightly scary DCA
    • Hamptons Legal - pseudo legal arm


    I think that's about it.

      Hitachi Capital UK PLC is "next door" literally and at the same address as Hitachi is Credit Solutions (Northern) Ltd closely linked to Clode Retail Finance

            So here's my first rambling letter for my new friend Bob:

            Data Protection Act 1998 Subject Access Request


            Dear Bob,

            I have decided to write to you personally as I have had a number of unpleasant experiences in dealing with other members of your company. As you are Compliance Director for Lowell Group I believe that you are the best person to address my request.

            Under the Data Protection Act 1998 individuals have the right to access the data that is being held about them.

            The Act defines “personal data” as any data at all that relates to a living individual who can be identified from it. This includes personal images and audio recordings as well as text.

            It is also important to note the term “processing”, which is a generic term used in the legislation to describe any action taken in relation to personal data, such as for example obtaining, recording, holding, adapting, retrieving, altering, disclosing or destroying. If you are in any doubt when handling personal data always assume you are “processing” it.

            The 1998 Act updated the previous 1984 Act which had come about as a result of concern over the management of personal data held in computerised records. Significantly, the 1998 Act brought 'structured' manual data within the scope of its provisions. The Freedom of Information Act 2000 then amended the Act to cover manual data held in an 'unstructured' form. Consequently, the Act does not now differentiate between any kind of electronically or manually held data.

            The Act provides the “subject access right” which enables individuals, subject to certain specific exemptions, to receive an intelligible copy of all personal data held about them by Lowell Group. The right extends to all data whether held manually or electronically.

            If an individual requests to see data relating to them which then turns out to be for example inaccurate, out-of-date, held unnecessarily or offensive, Lowell Group may be liable for prosecution. Of course I hope this isn't the case.


            My request is quite straightforward, I require copies of ALL personal information held by Lowell group concerning myself, the Data Subject.

            This request extends to any Trading Styles or affiliated companies that you may have been passed my personal data.
            For the avoidance of doubt this includes:
            • Lowell Group
            • Lowell Portfolio I
            • Lowell Financial
            • Red Debt Collection Services
            • Hampton Legal

            This request extends to ALL data held by Lowell group, this should include, but not limited to,
            • copies of original agreements
            • statements of account and transactions
            • information concerning any manual intervention
            • Telephone transcripts and details of all calls made and received
            • any other supporting notes and documentation
            • Also which members of Lowell group have had access to my data

            I hope Lowell Group complies with me request for access to personal information as quickly as possible, and will ensure that information is provided within 40 days unless there is good reason for delay.

            To this end I enclose the statutory £10 fee (cheque) along with details of previous addresses at which you have contacted me.
            If any other security information is required to verify my identity please advise accordingly in writing.

            I would appreciate your due diligence in this matter.

            I look forward to hearing from you in writing.

                Excellent letter.

                I have found that when I have had trouble with Lowell an e-mail to Andrew Bartle quite often works. He is their chief operations officer. Apologies if this has been posted before

                          So this has obviously hit the right place as I have received TWO seperate acknowledgements from RED debt today.
                          Normal waffle.

                          Shame the two ref'd accounts are seriously SB'd, but it's a start I suppose.
                          So I'll be expecting the same for the other heads shortly and hopefully a response from Bob himself, who knows

                              So still nowt of substance from Leeds, despite asking for everything they hold on me they have "conveniently" forgotten about my dealings from 2005/7 with Cap1.

                              Guess it's time to remind Bob of his obligations
