    Hi

    Im really hoping and praying you can help me with this. I have been following really useful advice on your website issued to other users with same problem but now have hit a dead end.

    Brief outline:
    Issued with letter of claim by Bryan carter solicitors in september 2015 on behalf of client lowell financial limited for littlewoods shop direct debt they are saying is £2521.73! On following advice on your website i sent a CCA request to Lowell- sending a copy to Bryan Carter solicitor for their records. I have just received back a RECON Credit Agreement from Bryan Carter which is just a printed out unsigned credit agreement with my name and address printed at the top of the agreement along with the terms and conditions. At the bottom of this agreemtn ar ethe words U2441981 RECON 08/05/2007. I think the U2441981 applies to the littlewoods account number and 08/05/2007 is when account was opened. There is no other information other than this document. - no account summary or statement- nothing? How do i now proceed with this? Im not denying i owe some money but i do not think it is anywhere near the amount they are asking for.
    Do i now contact bryan Carter? What do i do next please? If i offered monthly payments what is a reasonable amount they would accept - what do i offer? I do not want to go to court ofr have a CCJ against me. I do not own my own home i rent privately. I work full time but i only have my wages in the household as i am single and just live with my son. Please help me - you offer such good advice to others???? Thank you so much in advance.

      It would be helpful if we could see a copy of the 'agreement' to advise properly.

      Can you either upload it here (suitably redacted) or email to kati@legalbeagles.info who will display it for you.

              OK, bit rusty but here's my thoughts.

              The CCA requires that they provide a copy of ORIGINAL agreement or recon TOGETHER WITH a statement of account and any changes to thoseT&Cs since the account opened.

              I cant tell from here whether that is a copy/recon of your original agreement but a few things stand out.

              1. Check your Noddle report and confirm this account opened in May 2007. If it had been 6 weeks earlier, a recon would not suffice.
              2. Were you offered 0% APR when you opened account. If it was an introductory deal, when did it end? e.g 1 year interest free or what?
              3. The full T&Cs make mention of 'regulated by OFT' who no longer exist, so possibly these are historic T&C's
              4. Weird that their charges for default are not listed in Key Terms.

                reply: I have just signed up for a noodle account and it does not give any information regarding a littlewoods account?

                i don't understand how i should proceed with this?

                      Taking inspiration from your reply on 25/01/16 I sent Bryan carter an email yesterday 28/01/16:

                      "i have received a RECON CCA in the post today however it des not contain any infomation and the CCA requires that they provide a copy of ORIGINAL agreement or recon TOGETHER WITH a statement of account and changes to thoses T&Cs since the account opened. None of this was included. Is this going to be sent to me separately please?
                      Also it does not state WHEN the account was actually opened. And charges for default are not listed in Key Terms either?
                      Again thank you for time and attention in dealing with this and i await your response"

                      I received a response back from Bryan Carter on the same day:
                      "Thank you for your message. - Unfortunately we are now no longer instructed in the matter. You can contact the client directly. Lowell Financial, PO Box 1411, NORTHAMPTON, NN2 1BQ We are sorry for any inconvenience this may cause."

                      Can you please translate what this response means- im a little confused (doesn't take much!)? Does this mean that they have passedd the account back to Lowell? If so What should my next step be? Should i contact Lowell or wait fo rthem to contact me?

                      Please help - the longer this goes on the more ill it makes me with worry.
                      Again thank you so much Celestine for your help, i know you must be busy so your time in dealing with this is so much appreciated.

                        Hiya kirsty,

                        It means that Bryan have sent your case back to Lowell, probably as there's no proper documents and they know Littlewoods didn't very often actually get any agreements signed. It's a good thing as usually when this happens the case gets dropped.

                        As they haven't brought court action against you there's no need to push things, I'd just wait to see if you hear anything further from Lowell, and if you do come back and post xxx

                          Thank you SO much Sharon. Hopefully (fingers crossed) that will be the end of it and you will not hear again regarding this. If i do i will get back to you straight away.

                          Can i just give a big MASSIVE THANKYOU to yourself, Celestine and Kati. You have all given me such amazing support through this. To give up your time to help myself and other people who find themselves in situations through poor choices made in the past and cannot afford legal guidance to help them try to dig themselves out of a hole- what you do is truely amazing and so generous! i hope you get all the credit you and your team at legal Beagles truely deserve. I hope you dont mind but i have sung your praises to all i know - i hope it doesn't give you too much more work!

                              That Northampton Address I think is for Lowell Solicitors Ltd.
