    Aktiv kapital bought two MBNA Cards one taken out 2010 and one taken out in 1996 Defaulted on both 2009 - £3334.13 & 2010- £5976.15 to prevent a CCJ by default entered a defence on the basis SAR request requested Credit Agreement Default Notice Notice of Assignment - I had no knowledge of the debt. Only document subsequently provided the latest one credit agreement MBNA 2010.

    Claimant also applying for S69 of the 1984 County Court Act interest on both cards at 8%
    is that applicable and correct given one of the cards dates back to a start date 1996

    Case allocated to local court IND acting for AKTIV change solicitor when defended from Hegartys N181 Directions Questionnaire filed by claimant IND requested a month stay.

    Question surely without the credit agreements, default Notice, notice of assigment the debt is unenforceable my defence i have no Recollection of the debt claimant SAR
    Request made 08/11/2013 still not provided:beagle:The Court now require the N181 Directions questionaire from the defendant could you help how best to complete it must be done by 06/02/2014 I do not want to consent to a one month stay AKTIV have had the request since 08/11/2013 commenced proceedings and to date have not produced any notice of assignment any default notice and only one agreement, the history of the debt is the cards were held by MBNA they sold to experto varde who sold to AKTIV - ind are acting as the lawyer but are not lawyers and I suspect are paying Hegarty solicitors to use their name on the inital claim via Northampton CCBC - I am self employed so they wont be getting any attachment to earnings any help on this would be greatly appreciated.
