  • Grievance procedure severely delayed

    A friend is on sick leave whilst awaiting a grievance procedure to be completed.

    He has now been waiting 80 days for the completion of this grievance but the employer keeps saying that holidays have disrupted the process.

    Now, the serious part is that the employee's sick pay is about to run out and the employer has told them that they cannot have garden leave and have to go and claim DWP benefits instead.

    I believe that 80 days is an absolute joke so what route is open to this employee to rectify this situation or force garden leave pay to be made?

    Hi Lisa,

    The first thing your friend needs to do is contact ACAS. Their website is at Home - Acas . Grievances are supposed to be dealt with as quickly as possibly. 80 days is unacceptable. If your friend's Statutory Sick Pay (SSP) is about to expire, the employer should have sent an SSP1 to inform them of the date this will happen. What your friend now needs to do is contact the DWP and apply for Employment & Support Allowance (ESA). This has replaced Sickness Benefit. I am currently on ESA due to FM and can assure your friend the staff at the DWP are very helpful. However, they need to speak to ACAS first.

      just think on this

      the reason employers delay the grievance proceedure this long is that they are trying to run down the quaifying period to put in an ET1 CLAIM

      thats is three months less one day

      how long have you been employed for and what is the grievance about
