  • Restons - Attachment Of Earnings

I have a letter regarding a ccj being awarded against me by Cabolt (originally owed New Day/Aqua) £1,252.61

I don't deny the debt but financially very unstable and in other debt etc

They are threatening at attachment of earnings and have asked for a financial statement to be filled in.
I am happy to do that but it states all fields are mandatory including my mobile phone number and my employers details which i really don't want to give.... Do i have to??

Also i know that our expenditure is more than our income at present so much so that even tax credits have stopped taking an overpayment due to financial hardship. Bearing this in mind if i offered a small amount to be paid back monthly to Restons are they likely to accept?

    Huge thanks

Best bet is to file an N245 at Court for a Variation Order. Cost £50 but if on certain Benefits or low wage etc then you may be able to claim a waiver for the fee. The advantage of this is you could put say £5 per month as your payment and if your I&E backs it up a Judge could agree with you. Of course having it endorsed by the Court will make it more awkward for them to do anything else.
