  • Parking Eye PCN II - won

    Morning beagles,
    No response as yet to my appeal but in a bizarre twist, I have received yet another PCN, this time for an Aldi carpark managed by PE. On this occasion, it was a genuine shopping trip in which my wife was shopping for university supplies for our daughter. The car park also serves Home Bargains. Both stores were used and we have receipts from each. We shop in both regularly. As normal, the signs are mounted well above eye-level and hence not easily visible. Should we ask the store(s) to intervene or appeal? If we appeal, does the fact I have two PCN's against me as the registered keeper have any impact?

    Complain to store managers and appeal too.

    Dear Sirs,

    I, as registered keeper, wish to invoke your appeals process. The driver did not see any signs and was a genuine customer (see attached receipts). I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9.

    Should you reject my appeal please supply a popla code.

      Good news, following the above appeal and complaining to the store manager, the Aldi PCN has been cancelled. Hurrah!

      However, for the original PCN from Morrison's back in August (the subject of my first post), I've received a reply referring my appeal for 'further information'. I'm assuming this is a stalling tactic designed to encourage me to pay prior to issuing a POPLA code and I should ignore it? Whilst they wait for a reply, they've very kindly placed the PCN on hold.

      Any advise most welcome.

        A progress update on the Morrison's PCN: I received a letter today cancelling the charge. Thank's to all for the excellent advice, especially mystery1.
