  • CT Summons value disputed - LO still granted.

    Dear all,

    Went into court to help in reference to a summons issued by council for a liability order. The summons had date of issue, amount etc etc. My friend made a payment by chance on the date the summons was issued. The payment was made electronically via the council website with e-receipt. She wasn't to know about the summons until she received it in the post.

    The claim made in court was the summons had a figure which was incorrect. This was dismissed and LO granted, but an payment schedule was agreed.

    Was the court right to grant a LO?

      As above, yes the court were right.

      Simply because a figure has reduced doesn't prevent the remaining balance still being due as far as the summons and liability order application is concerned. The only way it would affect the validity would be if the whole balance + costs had been paid (or the balance otherwise discharged).
