  • Travel expenses

Hi, I have a son that lives with his Dad, this was decided by a court. In the court order my ex is ordered to do the travelling for both parts of the journey for drop offs and collection, which is from one side of London to the other. Since 2011 my ex has refused to do it, obviously this means that I now have to. He has also made a claim through the CSA/CMS. My question is, would I be able to claim my travel expenses back somehow as I am a single parent and the travel costs equal to around £40 per weekend that I have my son. This is a lot of money to me, it also means that I am spending money on travel that I would much rather be spending on actually doing something with my children. Any advice please?

If he is in breach of the court order then that should be addressed with the courts.

If/when the CSA contact you, make sure you make them aware of this and that it is taken into consideration in any calculations.

I myself have a similar situation, my 2 children live with my ex-wife and I have to travel around 220 miles every fortnight to collect them for the weekend and then drop them off. We set maintenance payments informally when we split thankfully.
Any opinions I give are my own. Any advice I give is without liability. If you are unsure, please seek qualified legal advice.
