      Re: Won!!!! Claim struck out!

Can you give a little more info how the claim came to be struck out - did you apply for it to be struck out? or did the court do it off its own back ?

This was a £10k overdraft wasn't it, so not straightforwards - they just provided no evidence at all on the debt ?

ahh - N244 unless order on CPR 31.14, AND a defence based on lack of documents.... they failed to comply with unless order and you emailed the court ?

(just to help others in similar positions)

        Re: Won!!!! Claim struck out!

        Hello Amethyst !
I suppose I was one of the lucky ones , the claimant never responded to my CPR request apart from agreeing to a 28 days extension( that the court failed to acknowledge anyway ) When it came to file my defense I have submitted in the same time an ''unless order'' and paid my £55.
The claimant was given 21 days by the court to provide me with all the paper work, they had until Monday the 5th at 17:00 to do that.
After my postman show up on Monday the 5th at around 14:00 with no letter from the claimant I have emailed the court to let them know that the paperwork was still not received by myself , the claimant therefore defaulted on the court order and I am asking for the claim to be struck out.
Today I have received an email saying that :
Thank you for your email sent on Monday the 5th of Jan.
The claim has been struck out and if I need any more info to contact the court.
        Happy days for now !
