Mortimer Clarke (Cabot) and defending CCJ

    Another interesting development after speaking with the Court this afternoon after receiving the letter from Mortimer Clarke over the weekend.

    Mortimer / Cabot attempted to amend the particulars of the claim on the 11 February but this was refused as they did not pay the statutory fee required to do so.

    This makes the content of their letter of the 5 March stranger as they state that Cabot will make an application to lift the stay if I do not enter into settlement negotiations within 14 days.

    i have also managed to dig out some older paperwork from August 2017 after I’d formally requested appropriate copies of CCA and their response was to issue me partial copies only.

    Shall I leave with a stay or pursue to have the claim struck out ?
