  • How likely the hearing is and at what stage is it when bank defends it or if courts transfer it to the localcourt incase unable to decide based on online claim

    • You file claim with MCOL, who send it to Bank
      Bank then have 14 days in which to signify if they intend to defend, and then a further 14 days to file a defence
      Altogether it is about 33 days taking into account postal times.

      If they defend eventually you will receive a form (directions questionnaire) to complete which enables the court to allocate which track the case will be heard on (almost bound to be small claims)
      You then get told which court (your local) it will be heard at and when.

      How long it all takes depends on how busy the court is.

      Very unlikely that a defended claim will be decided on written submissions only without agreement of both parties
