Can Lowell get a CCJ for a statue barred debt ?

    Please can you help/advise

    I have had a letter from Northampton for a Statue Barred debt that Lowell are trying to put a CCJ for.

    Are they allowed to do this ?

    First Steps they can try and hope you do not respond so read and follow the instruction attached and give us more detail credit card ??? etc last paynment s etc

    CCA Request || CPR 31.14 Request if loan/credit card send CCA1974 request Recorded delivery|

    CPR31.14 to the solicitors asking for only the items listed in the court form = free of charge Recorded Delivery

      Lowells have initiated court proceedings.
      They are alleging that legally you owe them some money. (I guess).
      They have to prove that claim.
      It would be wise for you to collate evidence to prove that they are wrong.

        Sorry I am not sure I follow either of the posts in reply.

        They have I assume at some point bought a debt I once owed, however this has since disappeared from my credit file and as such is statute barred (as far as I understand it)

        I have had a letter from the court and I assumed it was one of their tricky letters where they pretend to be someone else and didn't reply (as I feared corresponding would remove the statute barring)

        I have since spoken to the court who have confirmed it is correct that they have doen it and as I filed no defence they have struck out my defence and I need to pay £100 to fiel a defence now.

        Can they actually let them do this - the suggestion is unless I prove I am innocent they can proceed (as opposed to innocent until proven guilty)

        Please help - and again thanks a lot
