    It would be helpful if you post up the new contracts that Synergy sent you, masking any personal details.

    It is possible that they may find out about the Black Horse settlement unless you sign a new contract or letter of authority, you have no contractual obligations to Synergy.

          Thats very interesting Lifestyle Claims sold according to the Administrators Sharma's all the data and files to Redhawk.... yet it appears they have also passed on client details to Synergy Financial. Here again I believe data protection has been breached.

          Now Jim how much if any did you pay to Lifestyle Claims and what date was this paid? This is very important as Lifestyle were under a constraint by the Ministry of Justice just prior to them going into administration so it would be good to know all the information.

          Have you been back to your card provider to claim back the fees which I am asuming you paid upfront as under section 75 of the consumer credit act on the basis that no service was provided to you, you can claim back the fees if paid.

          My advice is do not sign these forms they cannot force you to use their service.

            Yes I did pay fees upfront, I can't remeber exactly how much ar the excact dates but I think it was around £250 in 2010. I'll have a look tonight as I'm sure I kept the paperwork.
            Do I need to reply at all to synergy?
            When I find the paperwork I'll contact my card provider too

              Many thanks for posting that up.

              You don't need to reply to Synergy but I would strongly reccomend that you complain to the MOJ compliance officer about you personal information being held and used by Synergy, which breaches the data protection act.

              The reason you need to do this is, as in the case of others we've advised, it will stop Synergy hounding you for money and will allow MOJ to investigate and hopefully prevent Synergy from attempting to scam others.

                I note that 5 (d) of Synergy's terms & conditions allow them to charge a fee even if you cancel within the 14 day cooling-off period.

                This is expressly forbidden by MOJ rules which state that:

                ''If you cancel the agreement inside the ‘cooling off’ period, the business will not be able to charge you a fee. You will also be entitled to a refund of any up-front fee you have paid.''

                  I have now managed to look for the paperwork, I have a 'PPI reclaim pack' from lifestyle claims dated 08th November 2010. I've no record of the upfront fee I paid. I paid with my egg card which the account was taken over by barclaycard just over a year ago.
                  Do I try and reclaim these fees from barclaycard or Egg?

                    If you paid by your egg card it is Egg that you go to, but if barclay card took it over then try Barclaycard.

                      You'll have to call Barclaycard and ask them who the sec 75 claim should be made to as Egg credit cards were taken over by Barclaycard in 2011 I think.

                      Ideally you should obtain your credit card statements for the period around November 2010 to substantiate the date, payee and amount for your sec 75 claim. You can either request the statements (once you've established whether it is Egg or Barclaycard who are responsible for supplying them) by simply asking them or sending a Subject Access Request. But if it was me, in the interest of time, I'd call the credit card fraud department who might oblige more quickly.

                      It's important that you make the sec 75 claim soon as possible as you must make it within 120 days of when you became aware of the problem - which presumably would have been at the point that Synergy informed you that Lifestyle Claims had gone into administration.

                      You should make your sec 75 claim for 'breach of contract' on the basis that the fee was fully refundable but the company ceased trading before your contract was concluded http://www.theukcardsassociation.org...uide(1)(1).pdf

                          We have just been paid by cheque our pip compensation by fcsc. Today we had a call from someone
                          calling himself a Manager from Ultmate Law requesting that we pay Redhawke
                          30% + vat. We do not have a signed contract with Redhawke, but we did with
                          With Lifestyle Claims who have gone bust. Where do we stand? Thank you for

                            Very interesting you been paid by FCSC, thought they would only pay out on a company gone bust, seems someone should be getting this in order as it is an absolute mish mash of who owns what, who owes what and exactly how people can get their stolen money back.
                            The FCSC would never have paid out imho if Lifestyle had legitimately been bought by another company

                              You do not have a contract with either Ultimate Law or Redhawk Legal. You have NOT signed any documentation to these companies and they have no right whatsoever to be harrassing you. Lifestyle Claims are in administration and therefore are not in a position now to collect money from you as they have had their authorisation cancelled by the MOJ.

                              Ask them if Ultimate Law/Redhawk Legal that if they call you again to put everything in writing to you so that you can take legal advice and with the MOJ + TS. Then I would ask you to upload that documentation up here if they ever put anything in writing which I doubt they will so we can then advise you what to do next. You have definately not signed any T&C for Redhawk so there is nothing they can do to you if they keep harrassing you I will get a templated harrassment letter for you to send to them. Bank your cheque.... well done and worry not.

                                I think that its unlikely that the call was actually from Ultimate Law, but from Redhawk themselves.

                                Because the claim to FSCS would have been originally been made by Lifestyle, FSCS would have have written to the Lifestyle office with notification of the compensation award (unaware that they'd gon bust) and Redhawk would have picked it up as they now occupy the same address.

                                Take Tuttsi's advice and if they write to you about anything, let us know and we'll help all we can.
