Abbey / Santander have in the last couple of days written to all Courts asking that ALL bank charges cases be dismissed in light of the OFT v Abbey test case Judgment.
You SHOULD have had a letter from Abbey informing you of their intention to apply to dismiss your claim, but if not, then we would recommend contacting your court to check the position on your claim.
You can then write to the court outlining you are responding to Abbey's letter and either agree that your claim should be discontinued or confirm that you intend to continue.
Hopefully this should stop the courts striking everyone out without informing claimants in advance and give claimant's opportunity to defend the dismissal application.
If the court do strike your claim out and send you a order to this effect you will have 7 (SEVEN) days to apply to set aside the order and ask for permission to amend your particulars of claim. A copy of your proposed particulars of claim should be sent with the application ( form N244 & application fee )
