I'm after some advice and really hope someone can help.
In 2004 i bought a car on hp through British credit trust. I had the car for approx 8 months before sending it into a garage for repair, the garage brought to my attention that the car was cloned on false number plates with a fake vin number. I contacted the police who said it was a civil matter as they had no idea where it had come from. British credit trust said it wasn't they're problem either and i should take it up with the supplying dealer. I informed them I had done this but the dealer had closed down.
I surrendered the vehicle back to bct and told them I wasn't prepared to pay for an unroadworthy car. This lad to a stand off between us as they were insisting I still had to settle the agreement. I moved house about 4 months after and never heard anything until 24/12/16 when an attachment of earnings order fell through my door. I filled it out and sent it back and the court have given me a suspended order. I was given a deadline of 30th January to make the first payment to Mortimer Clarke which I have done.
What would be the best way to challenge the validity of the credit agreement?
The original CCJ was made in 2010 which I knew nothing about.
