I have a question that I am hoping to get help with. I will try to keep the story brief.
In 2008 I started a job at a school, the advertised pay was an incentive and that's why I took the job.
A few months later due to ill health I had to leave, a few months later I received a letter saying I owed money as I had been overpaid. I disputed this as I had not been overpaid in my eyes.
Then, my health took a turn (I was diagnosed with a mental health condition which I was medicated for), but I tried to continue as you would, but only looking back on it do I now recognize the severity.
The local authority who had employed me said if I did not pay, I would go to court. I maintained a clerical error, but the took me to court and I got a CCJ against my name. In my naivety I wrote a letter before the CCJ hearing that I still maintained the clerical error and would pay them £10 a month to avoid court, they refused this, but said it was an admittance of guilt.
The CCJ was granted in 2009 at the same time I was dealt the full diagnosis of my condition.
In 2013 I decided to deal with my financial affairs and looked into the CCJ. I requested all the paperwork form the local authority. When I got this I found several things.
My payslips showed no overpayment. I was also underpaid in fact, it transpired the advertised rate for the job was less than the actual salary by £1500 a year. I found this out by the paperwork. In fact, there was no evidence of an overpayment and at that time could not be confirmed because the school had gone from Local Authority into an Academy so there were no records of the pay roll from that period.
Armed with this I approached the Local Authority, who to my absolute shock, did nothing. When I pressed them they said I still owed the money and they produced an amended ccj which was done by hand.
Basically they can not prove the debt, I maintained an error and I was right, I was underpaid etc......Basically they have said I can't do anything but pay now and have sent me a date for a means enquiry.
I am getting nowhere, surely there must be something I can do..I am loathed to pay something I do not owe.
Can someone give me any advice on this, I now the CCJ will drop off my credit file this year. I want to deal with the CCJ and the local authority.
