  • Full and final settlement letter advice please

    Hi all,

Below are some extracts from the full and final settlement letter I will be sending shortly, may be a stupid question but just want opinions as to whether this is acknowledging the debt? - I am of course offering to settle account so I guess it is. Not complete letter, circumstances, etc I have removed.

    WITHOUT PREJUDICE

'I write with reference to the money which you are claiming on the above joint account. I can confirm that that I am unable to offer to pay the money which you are claiming to be owed in full.'

'Taking the above into consideration I want to offer £****** as an ex−gratia payment in full and final settlement of the account, including any subsequent third party claim. This money will be provided by a family member and will only be available for a short period of time. This is not an acceptance of any liability for the amount claimed. This offer is made on the clear understanding that, if accepted, neither you nor any associate company, will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released from any further liability.'

Not sure if above bold statement would suffice? Thoughts welcome. Thank you.
