  • Me Vs Cabot Financial

    This was an easy win, and i dont recommend my methods.

    Cabot sent me a letter asking for a tiny amount 20.50 from a 2009 debt, for sometime in 2009.
    A quick calculation in my head, No matter when in 2009 thats a minimal of 6 years and a max of 7 (hey statute barred)

    Knowing full well there is no way i can be talked into agreeing to anything, and the debt was certainly statue barred i rang them up
    (im fairly sure NO ONE RECOMMENDS anyone does this keep it in writing.)

    First i found out i had been connected to a call center, yet another company which uses call centers.
    I then asked precisely when the debt had defaulted, and they said it defaulted in july 2009 (yay i thought definately 6 years passed)
    Then they said "no a payment was made for £2.50 in 2012. (They had to be mistaken. Because it could not possibly have come from my bank account. which was opened in 2011 and never used to subscribe)

    So the first thing i wanted to know what of course who made such a payment, they couldnt tell me of course
    Then i asked did they have a signed credit agreement, to which they admitted no and they couldnt get one either
    So i maintained calm, and stated I dont owe any such debt and your not showing me i do
    So i make it CLEAR I will not be paying this debt now or in the future as i do not believe such a debt even exists.
    They are then trying to ask me why i think i dont owe a debt and that i should remember
    I reply I dont remember any such debt, that is why i am asking you to show me where the debt is from, and the details
    This went round in circles at least 4 times
    Eventually i reminded them that i wont be paying the debt and its statute barred in any case regardless.

    They said they would be writing to me to say the debt had been written off.
    So i responded "i dont owe a debt to be written off" ( I kind of figured dont accidently accept a debt at this stage) <<<< Why its not recommended to call.

    So the call ended with me wishing them a happy holiday and happy new year, and waiting them to write to tell me i owe them no money.

    A few things to note:
    The onus is on them to prove I owe such a debt, and telling me to "remember what happened" isnt proof of anything.
    When they say they will write off your debt - NEVER acknowledge it is your debt. Instead say "please confirm i owe you no money, as you are unable to prove otherwise.)
    As its SB- make it clear your not paying. (They cant take any action, so basically have no choice but to write it off)
