    Hope the FOI originator doesn't mind me posting this up - here is a copy of an FOI request response from March about the number of county court claims brought by Ernest Wilson in 2012, 2013 & 2014.

    They do seem to claim commission on top of marketing and advertising costs, we are writing to EW for copies of the agreement etc but for now this is an older section of the T&C's




    A different version states
    Charges, Costs & Expenses.
    Sale of Shares in a Limited Company
    3.0 ln the event that a sale of shares of a limited company is effected commission will be calculated in accordance with 3.01 and/or 3.02 below based upon the last advertised price of/the business and/or property prior to instruction of Solicitors to deal with such sale.

    Sale of Business and/or Property or Letting of premises at a Price/Annual Rental of £60,000 or less.
    3.01 Commission of two thousand pounds plus advertising and marketing plus V.A.T. will be charged on any sale at a price of forty thousand pounds or under (including the transfer of an existing lease or the sale of fixtures and/or fittings which for the purpose of this clause shall be deemed as a sale of property) or letting at an annual rental of forty thousand pounds or under. In respect of and sale letting between a price/annual rental of forty thousand pounds and sixty thousand pounds inclusive, commission will be charged at five per cent of the selling price/annual rental of the business and or property plus advertising and marketing plus V.A.T.

    Sale of Business and/or Property or Letting of premises at a Price/Annual Rental greater than £60,000.
    3.02 Commission of five per cent of the selling price of the said property and/or business plus V.A.T. will be charged on any sale at a price in excess of sixty thousand pounds or in the event that the premises are let and no business and/or property is sold and the annual rent exceeds sixty thousand pounds then five per cent of the annual rental plus Value Added Tax will be charged.

    Advertising and Marketing Charges.
    3.1 Advertising and marketing expenses will be charged at fifty pounds per newspaper insertion plus V.A.T. and Ernest Wilson business catalogue insertions at forty pounds per insertion plus V.A.T. the cost of erecting a ‘For Sale Board and Sold Slip’ will be Eighty Five pounds plus V.A.T. and for the cost of preparing photographs of the business and/or property a charge of seventy five pounds plus V.A.T. will be made plus a further ten pounds plus V.A.T. per fifty miniprint photographs ordered or printed by Ernest Wilson on your behalf.
    Which says no advertising/marketing on top of commission if sale if for over £60k - unless 3.1 is handily joined with 3.02.


    Normal estate agents charge what, 1.5% ?? including all marketing, accompanied viewings etc.

    There are certainly some major inconsistencies there. They're also trying to charge for commission PLUS advertising & marketing "costs". Do any other agents charge like this?

    Andreawx, do you have a copy of the terms of business? If not, you can get hold of them by making a subject access request to Ernest Wilson for all the information they have on you and your parents.

    They don't seem to be able to make their minds up on numbers. Prices, quantities, dates... almost like it's just made up. ( June 2015 and latest invoice works out but doesn't go anyway to explaining Nov 14 and May 13)

    I have e mailed all I currently have to work with.. The most shocking part for me was the last invoice sent to Mrs J Fish & Mr M Fish (deceased) to my home address although neither have ever lived here.. The communication since has been to my mobile saying he will take court action to my address if I refuse to give her new address :-( I have no contracts signed by either parent. Nor have they got anything from my mother agreeing the £2000 withdrawal fee

    Ahh so they are trying to charge your mother almost £10k for not selling the cafe over 10 years it was on their books ?

    Did you father make his cancellation requests in writing?

    any chance you can photo/scan in a copy of the latest breakdown of charges and letter threatening court action ? - remove personal details before posting it on the site - or email it me admin@legalbeagles.info.

    And if you dig up a contract of course.

    £9484 is there charges that they are intending court action.. Sadly we have very little paperwork, However the paperwork we do have is very conflicting, from one breakdown of charges to another they differ. Originally 10years ago my father would have solely dealt with all correspondence from them, there salesman convinced them that they already had a buyer for there café and it would sell within 7days, alas said buyer never appeared x My father insisted many years ago to stop all advertising at his cost. This did not happen either.

    Okay from April -
    they told me same and never sold my business and now slapped with a court warrant of possession to get out my house and demanding 6000 for a business they never sold and a contract they changed and countless lies in court
    did you defend this ?

    Do you have copies of the original contract to evidence the changes ?
