Hi ruby, or anyone else who picks this up, its been a good 6mth since last letter from arrow global, to say they are still looking for paperwork from orignal creditor. Sorry to bother you again, just worrys me sick really, it starts me off again watching for postman, i do hope they dont find any of this paperwork, well agreements, any advice is most grateful.

There's nothing to worry about, as they say: no news = good news! :thumb:
If they've been waiting for paperwork for 6 months, there only one conclusion we can draw: they haven't got it!

If they haven't contacted you during this time, I'd just enjoy the peace and quiet and let sleeping dogs lie.

Aww thank you both for taking the time to reply to me, sorry to go over same old thing time and time again, its always there in the back ground, when i think its gone away you can bet every few month that arrow global send a letter to start the worry off again. I'v since got married so my names changed, i havn't told them that so all the letters come in my previous name, not that that matters, still my debt. Plus i'v not told anyone about this. Its like they keep me on my toes, we are still here and still searching for signed paperwork. When i do get a letter from them, i'm shaking from head to foot hoping and praying they havent found anything. Thank you for your help. X

Try not to worry, it really is a waiting game, till it goes SBd. :clock:

Arrow won't 'find' anything themselves, they would have to obtain any documents from the OC, and if they haven't been able to do so, that means they're just not available. :thumb:

But, this letter today from them asks for me to complete and return to them my in and out goings . The letter says, i quote. We can confirm that we have been informed that the original application in relation to this account is not currently available, please confirm your intentions regarding repayment & return financial statement to us. Please help i'm worried sick now again. Thank you for a reply.

Don't worry! Restons are Big Bad Bullies, but the fact that they confirm they cannot comply with your CCA request, means they can't take this to court, because they wouldn't be able to provide the documents. :grin:

All that's left for them to do is ask you to pay, but they can't MAKE you pay! That's the thing. :thumb:

It's quite obvious the agreement for this account cannot be found, keep the letter where they confirm the original application is not available.

You are under no obligation to provide ANYONE with a financial statement/I&E form. See this: http://www.legalbeagles.info/forums/...987#post386987

Hi Dippydoo,

This is really good news for you, so don't worry. They're saying they can't find the paperwork but want you to pay anyway but, they need to prove that they're allowed to collect this debt. After all, I could write to you and say you owe me £6.5K but that doesn't mean it's true.

Write back to them, enclosing a copy of your letter to Arrow and their replies to you, and say that you have no intention of doing anything until they provide the information that you requested on [insert date] Put at the top of the letter that you do not acknowledge any debt to them or any of their associates.

Don't fill out any financial statement.

Is it just a normal letter i write to these restons, i dont have to be sending them, i no not of this debt or anything like that. Is it just a simple letter where i'm saying provide the proof? Thank you for kind help everyone. X

Below is a letter you can respond with, telling them that, as long as Arrow can't come up with the goods, the account is unenforceable due to lack of compliance with your CCA request. Send it recorded delivery and sign using a computer font rather than your real signature.

Dear Sirs

ACCOUNT NO: xyz

Your attention is drawn to the fact that this account is subject to a serious dispute. On XX/XX/XX, I requested from Arrow Global a copy of the credit agreement covering this account pursuant to the Consumer Credit Act 1974 section 77-79. To date Arrow Global have failed to comply with my request. Without production of the said agreement I am unable to assess if I am indeed liable for any alleged debt to Arrow Global, nor does it give me any chance to evaluate whether any original agreement was ‘properly executed’ as required by the Consumer Credit Act 1974.

In line with recent OFT Guidance surrounding Unenforceability, I presume you're aware that the OFT has stipulated the following;

Sections 77-79 of the Consumer Credit Act 1974 outline the information creditors must provide to debtors under fixed-term, running account & Hire Agreements. Under these sections a debtor can pay £1 to get:

• a copy of their agreement
• copies of some of the other documents mentioned in their agreement
• a statement of account.

If this information is not provided within 12 working days the debt becomes unenforceable. This means a creditor cannot:

• make the debtor pay the debt before they're supposed to
• get a court judgment against the debtor

As this account is clearly unenforceable, I expect you to write back and confirm that no further action will be taken and that the account is now closed and no further correspondence will take place.

See above. The letter doesn't say you know nothing of the debt, it just says you need to see a copy of the alleged agreement to ascertain your position. :thumb:

Hi there flaming parrot, well i got your letter downloaded & printed off, got it in the post to bully Restons, sent it recorded delivery, so il wait & see what happens now, you know me by now, il spend my time waitng for letters to drop on the mat, very worried times.
