      Is there anything else that I need to do on this over the weekend (apart from hod suggesting I complain to the ico)?

      do I need to write to mortimer clarke or marlins about the lack of compliance with the sar or anything?..........

        have you heard anything back from scumbags united (sorry debt release direct) on the SAR you sent them yet ?

            Polite reminder sent to Mortimer Clarke about my information request & what they actually sent me.........

            Date 7th September 2009

            Section 7 - Data Protection Act Subject Access Request
            Account ref:

            I write regarding your letter dated 02/09/2009 & the information which you enclosed with it.

            I sent a formal request for information under section 7 of the Data Protection Act, including the maximum £10 fee, to Marlin Financial Services Limited on 25/07/2009.

            You will be aware that under the Data Protection Act 1998 you have an obligation to comply fully with my request within 40 days.

            As of 07/09/2009 I have not received complete information from you or your client. I’m sure that I don’t need to remind you of the information that I am entitled to.

            If you or your client do not comply fully with my Subject Access Request by 14/09/2009 , I shall enter a complaint to the Information Commissioner.

              Further to my email to mortimer clarke yesterday (see above).... I've received a data file today (funnily enough it was in a marlins envelope but on a mortimer clarke letterhead )& am just reading through it now.

                On the transaction history, it says ......

                21/07/09 that they (Marlins) emailed debt rel direct to advise of balance of account as advised by legal as £12334.81 & that interest is being charged at 8.


                23/07/09 drd rang to query the balance (which they told me they had) because the letter marlins sent me said I owe 10k. Marlins advised drd that the letter they sent to me was an admin error & that the actual balance is acruing interest as per the court order........

                09/03/09 judgement order rec'd mortimer clarke

                09/03/09 mcs-substitute claimant recd from leic cc dated 11 feb 2009
                - would this be the court info we are looking for? Awaiting sar info from leic cc...

                Something else which I have noticed is...

                Phoenix arent mentioned, nor is there any paperwork regarding the sale of the debt to them or correspondance from them assigning marlins as managers of this a/c - despite the covering letter from mortimer clarke saying that what I've received includes all systems notes, letters & additional case notes. There arent any copies of the emails they have sent drd nor any court docs either....

                There is no statement of account showing my true balance either...
                Is it time to fill in the ico complaint form?


                Would anybody like a copy of this emailing to them? Its not huge & I might be missing something.............. - have emailed to cb & ame for their opinions

                  I've received my sar from leic cc & enclosed was........

                  19/10/07 Notice of hearing of application (defendents application for suspension of warrant). me v hfc

                  08/11/07 Final charging order

                  & then...

                  02/03/2009 (which I didnt know about) General form of Judgement or order where Phoenix Recoveries UK limited s.a.r.l - Potomac Recoveries be substituted as claimant in this action in place of hfc bank ltd.


                  Does this news create any problems?..........

                        Going back to when I sar'd HFC (beneficial), the information was incomplete & I sent the following letter by recorded delivery on 7/9/09 &.....

                          Just to confuse matters more......... Today I have received....

                          A statement from Phoenix Recoveries (UK) Ltd!!!!!!!

                          This is their first correspondance to me & my o/s bal @ 20/10/2009 = £10883.79.

                          There is also an address & telephone number for them. Am I best to sar these before starting the court claim?... Granted it's a p.obox number & then the same post code for mortimer clarkes & marlins.... but its an address nevertheless. They might send the 'assignment' info? LOL!....
