    The people who supposedly own my debt have a luxembourg address & today is the 1st time I've received anything (supposedly) from them....

    What came today came from the worthing address (which is their supposed agent - they tell me this but havent provided any proof) & as I was just about to get the court file together, I just wondered if I should sar them also to 'cover my back'..................

        Mortimer Clarke have kindly sent me the cca which I requested on 24/6/09.
        It is the same 1 I received in my sar bundle from hfc & cb has already deemed it rubbish!

        They finish their letter by saying "we trust this is of assistance & that you are now minded to settle your outstanding debt to our client".

        Great arent they!

            Everything they do & say is certainly a joke but they seem to mean it...which is a scary thought! lol!

                Maybe? Its not just 1 limited company they hide behind...its lots (well I have 3 letterheads & the oc so far)! Which is prob why I have the 1 debt being recorded on my credit file several times by 2 different companies for different amounts.... when asked to sort it, they said no. they seem to be a law unto themselves & I will be visiting ts with my file... will have to be next wk now tho'! I hope I dont confuse them with it. lol!

                  Im just going through the paperwork I received from Leicester County Court when I sard them. Heres a list. If anybody wants copies of anything, let me know

                  19/10/2007 Notice of hearing of the defendants application for suspension of warrant(?)

                  02/03/2009 General form or order-Upon reading the ExParte Application it is ordered that... PHOENIX BE SUBSTITUTED AS CLAIMANT IN THIS ACTION IN PLACE OF HFC BANK lTD.
                  (Im assuming I should of known about this).


                  ive tidied up my file & think its ready to be shown to ts now

                    I've had a letter from Marlins saying that this debt has been passed to them to recover & they wish to speak to me to arrange a payment plan....

                    They've asked me to call them or sign the statement of means they have sent me with my proposed offer of repayment....

                    I am already paying (via the dmc) the amount which the charging order states so should I just file this?.....

                      Just joined this site and picked up on your thread.
                      I,too, have had a similar experience with this Marlin/Phoenix outfit after my HFC debt was apparently sold on to them.
                      I have a charging order with HFC for a set payment each month which i comply with religiously.I just pay Marlin monthly(instead of Restons who collected previously for HFC).As far as i am concerned i will continue to pay as per the charging order instruction and they can go and take a running jump if they want an increased payment. I think if they took it back to court they would have some grief from the judge.If i was you i would sit tight and continue to pay as per the charging order instruction.

                        Hi all, I finally feel brave enough to face my situation again so am just updating this.

                        I've just looked at the land registry & the charging order relating to this is still dated 2007 & saying it is hfc's so I am wondering if there's anything I can or should be doing regarding this as it is still a big mess & I'd like to get it sorted out if I can.
                        it looks to me like hfc have the charging order but marlins are claiming the money I pay through a dmc. As the agreement isn't valid, might it be worth stopping paying & seeing what they (marlins) come back with?
                        They intimidated me so much last time...the threats of the interest & taking the house are still in the back of my mind.
                        I will check my credit rating again to see if it shows me still owing 2 companies the same debt.
                        sorry not been on by the way, I got assaulted last July & court only finished in February so have kind of been limiting what I tackle & keeping stress to the minimum.
