    Well.... I have just wasted my afternoon waiting in for the court guy to ring me (he wouldnt take my mobile number)...GREAT!

    Happy suggested that I SAR the court so I've prepared the letter & will be sending it first thing...

    I am truly shocked about the courts unprofessional behaviour... & not sure what to do about it or me not receiving the letter they say they have sent me...

      I have received sar info from hfc/beneficial today.
      There is a copy of a signed agreement in there... can I email it to you for your perusal? emailed to Amethyst & Cb
      I am so confused! The last statement that they have sent is dated July 2009 & it shows a balance of £8875.00 (as per my credit file). Each statement shows nil interest & the last payment to go to the account was on the June 2008 statement. Interest stopped being charged on this account from the April 2007 statement....

          Well nothing obvious has jumped out at me yet! Im just going to have a closer look at it & will let you know if I find anything. There is a comment from when I spoke to the charges guy... when he said the account was sold, I said who to & it says that I queried the account & he advised me to call lits (litigation I guess)....

            Charged Off just means they have shunted it into the abyss of bad debt

            Mind you it does mean it's a non-interest bearing account..

              I can't see anything referring to assignment.... just the sold bit I mentioned above.... There isn't any correspondance to my dmc either which I find suprising!...

              Is there anything I need to be doing regarding this????

                    I can't tell you how many times I've checked my paperwork to cover my back & ensure that they are the same accounts!

                    Any advice on this? & Any comments on the cca I emailed you?

                      Let me get this right.

                      You are paying Marlins and HFC a monthly amount for the same debt, which as you stated earlier in the thread [QUOTE] Each statement shows nil interest. They cannot add charges like this, surely they cannot take payments for the debt twice. I am very confused.

                        I am paying a monthly amount... just 1 amount!
                        It was going to hfc (it shows on the stmts until june 08 & interest is frozen)
                        & it now goes to marlins.... (their statement of account didnt show interest on it either...) marlins say the debt was sold to phoenix & phoenix assigned them as their agents. no proper paperwork has turned up yet! (remember the court palava & it must be missing from todays sar info I rec'd) So, Leicester County Court sar'd 28/8/09.

                        Marlins supplied me with a statement saying I owe £10941.00.
                        They supplied my dmc with an outstanding balance of £12334.81 (theyve told my dmc theyre charging interest because its a secured debt. £120 a month I think they said.). I have in writing from the dmc the £12k balance & also an email saying theyve never dealt with phoenix. The dmc has called me & apologised in regards to not being able to get this account under control with marlins.... The dmc was sar'd 25/08/09.

                        hfc have provided statements in my sar info up to July 2009 showing the balance as £8775.39. It's been this balance since June 2008.

                        So... my monthly payment is going to marlins as per my dmc... I feel like Im going mad too lol!


                        Should there of been info regarding restons work on the account, in the paperwork? lol

                          Your SAR should of included EVERYTHING, including all of the legal paperwork as well as the assignment.

                          Time for another letter chasing these other referenced documents.
                          Don't be too specific, but remind them of their duty under DPA

                          Something along the lines of requesting the additional information that is mentioned but seems to be missing from the SAR bundle. Mostly concerning the leagl action and subsequent sale of the account..

                            I suspect that there must be quite a bit missing including whatever work the litigation department has done for starters!
