    But that was not what was requested or agreed with Rachel.

    Rachel said in an email to you yesterday that she was requesting another BACS payment. I suspect that the money was credited to your Cap One account yesterday and a BACS payment will be made today which will be taken from your Capital One account. It's all to do with balancing the books.

    There is no panic to inform the Court, let's wait a couple of days for things to settle down before officially closing off the claim with the Court.

    I know it seems like a lot of messing around but would prefer to make 100% sure that things are sorted before we officially remove the leverage that the open Court claim affords you.

    Have you actually had a written statement through from Capital One yet which shows the balance as having been reduced to zero? I presume that the checking you have been doing has been via an online version of the account.

      Not yet budgie only seen balance as zero on line. I will wait for it or request it from rachel before writing to court. Thanks again for advice x:clgblinkie171:

        The money was credited to my Cap One account Friday and looks like a BACS payment will be made for tomorrow into my account as cap one balance is now showing as a debit & it was a credit on Friday! So like you stated it is all to do with balancing the books.

        I will let you know once it is 100% certain that money is in my bank tomorrow

        I will also ask Rachel to send me a written statement from Capital One which shows the balance as having been reduced to zero.......befire I write the letter tot he courts.:2w32gd1:

              I would like to wish everyone a Very Happy Christmas and a special big thank you to everyone who has helped me with claiming my Credit card charges back especially Budgie, I couldnt of done it with out you hun.

              I will let you know once I have recieved my letter from Cap one with respect of my credit card acoount being settled, then I will ask you for the help with drafting my letter to the courts.

                I have resent my email to rachel howey today in regard to her sending me aletter of confirm that my balance onmy capone account was put to zero before I wrote to thecourt and you were kindly going to help me with drafting a letter tothe court. However rachel email has bounced back today as failed! are you aware if she is currently still working for cap one?

                I could forward it to AlanSwain couldn I?

                  Think I will email Alana Swain as Rachel Howey email keeps coming back failed! I need it in writing that my account was set to zero after getting my refund from cap one..............I am keen to writhe to the courts as promised to confirm the case closed.

                  You still happy to help me draft the letter tocourts?

                  I hope you are well as havent seen you in the site fora while.

                  I also received aletter from Abbey this morning for my bank charges that was put on hold saying the usual banks have won against oft etc etc and they wont be refunded my bank charges; I guess everyone has recieved their letter the the same effect............ the gits still charged my £100 in charges though for last month on direct debits not paid; Abbey are still charging £35 for these failed DD's compared with Nat West who only now charge £5!!!

                    Is this enough for me to write to courts to stop claim and confirmt he case closed?

                    Dear Angela,

                    Alana has sent me your email as I am now picking up queries relating to Rachel's cases due to her having left the business.

                    Your Capital One account cycles on the 13th of every month. Therefore, a statement will automatically be generated on Wednesday this week.
                    This will show a -£228.78 and a +£228.78 'Balance Transfer Adjustment' on the 17th and 18th of December.

                    I hope this is the clarification you are looking for.

                      I take it you have now received all the money ( via BACS ) that you were expecting?

                            Can someone help me with this letter court claim continuation? Budgie was going to post it up for me But I havent heard from him. Hope all is well with him?

                            It was back in December my pay out from Cap One; prob bit late now isnt it to send letter? Courts havent heard from me.... any thoughts?

                              I recieved a general form of judgment or order from Guildford County Court as they still havent heard from me with regard to my cap one claim being settled back in December.
                              I have been very busy and time ran away and I should of wrote the courts by now.

                              Any how I have let CAp One know via email that I am happy that my claim was settled; as they sent me an email............. I also said that I would let the court know that I am happy my claim has been settled.

                              The letter states that unless I file an allocation of questionnaire by 4pm on 17 March the claim shall stand struck out.

                              Shall I just call the court and explain I have had payment or write them at this point?? All advice gratefully recieved

                                I need some help please; Anyone? not sure where Budgie is; anyone know if he is ok?

                                I called courts telling them I didnt want to apply an allocation questionare and I am happy as cap one have now settled; I have also told Cap one this too.

                                The courts however DID suggest I did need to put this in writing! can anyone help me with drafting something up? I know Budgie was going to put something together for me to use, but i havent heard from him. I do hope he is well.
