    Just a thought; if I dont hear from Rachel tomorrow either by telephone or email; I will call he again, if I dont get straight through,is it worth dropping her an email?

        I have heard from Rachel Howey via email;she apologies for not calling as she hasnt had cance to seek advice re: the stat interest asked for.

        I will wait till tomorrow afternoon orWednesday morning, giving her the time needed! what are your thoughts?

        Shall I reply to the email? or just wait and then call her?

          I too have left a message with Rachel and left a couple messages to call me back.

          I did recieve one message on Friday saying she hadnt forgot me and was waiting to seek instruction regarding stat interest issue.

          I replied saying many thanks etc etc. and have chased again since

          Think I am being kept waiting!!

                Hi Flangies, i have just read your thread, congratulations, on your result, lets hope they agree to the 8% too. I am still waiting for a reply from Rachel Howie, to my email, sent last week, have just sent it again! Hopefully will get a reply soon. Good luck with your claim.

                  Thanks; it is a fab result isnt it, it is frustrating though waiting for an answer from Rachel; I spoke with her last week, she is very nice, but obviously making me sweat a bit.

                  In the meantime they reckon the cheque is on its way, which is why I want it sorted before the payment arrives, I have also asked for payment by BACS, lets hope they agree to that too!

                  Good luck with your claim hun and lets hope you hear from her soon too.

                    Thanks Flangies. I have won another case against Capital One, but they tried everything to disrupt the case. They even wrote to the court saying they had settled in full, so the judge wasnt expecting anyone to turn up, so he didnt read my court bundle! He was very suprised to see me, but did award me charges interest, damages, and a days money for earnings lost. So Cap One were furious lol. Served them right.

                        Still not got any real news; I left 2 messages for Rachel to call me, and emailed a couple of times. However I did recieve an email yesterday saying she hopefully will have an answer for me Monday!

                        I think she knows I aint going away however, I am worried she is stalling.

                        Also I dont want to become a nightmare by constant ringing and leaving messages.

                        What are your thoughts on what is going on? As we hve discussed I have nothing to lose by asking for the extra tp be added on, but I just need an answer one way or the other.

                        I sure hope that do hear Monday, and of course the news isgood, and that I get it paid by BACS, it would sure be a nice Christmas bonus. lol

                          She is obviously busy.

                          However I just want to check the situation regarding the Court claim.

                          In your post on 25th November you said that you had received the letter from Capital One and an allocation questionaire? You already posted up a copy of the letter from Capital One.

                          I presume the allocation questionaire was from the Court, what was written on the allocation questionaire? Please post it up if its easier !!

                          Have you received ( from the Court ) a formal copy of Capital One's defence?

                          Have your received any other written communication from the Court since the aloocation questionaire, or from Capital One since the letter on 25th

                          According to my estimate of the dates. Capital One have until Monday 7th December to formally file their defence with the Court and they should send you a copy of this. Sometimes they do not send it out to you but in any event the Court should send you a copy. Normally the Court would send it out with the allocation questionaire, but you already have that ????

                          Nothing for you to worry about, its just me wanting to make sure that we are perfectly OK as far as the Court is concerned.

                              I removed the attachments as they contained your personal details.
                              No need to post them back up now that I have seen them.

                              There were two things from the Court

                              1) Notice that the Defendant has filed a defence, I presume that there was no defence attached? That's quite usual, courts are useless. Capital One should have sent you a copy of their defence, they havent, that's quite usual as well, they are useless too. What Capital One did send you was a letter basically detailing their idea of a settlement and saying that they would defend on the basis that they have settled your claim in full. ( Thats basically all that their defence will say anyway). As previously explained this is standard practice for Cap One.

                              2) An AQ, which needs to be filled and sent back to the Court by 11th December if you wish to carry on with the claim. OK, you probably don't want to continue with the claim, even if you are not successful in getting the additional 8% on top of what they have offered.

                              However, we can use the fact that you need to submit your AQ by 11th December as a little bit of an arm bender as far as Capital One as concerned.

                              I suggest a further email to Rachel ( over the weekend )


                              Dear Rachel,

                              Thank you for your email dated ( friday ?). I look forward to receiving your revised proposal, for settlement of my County Court claim No xxxxxxxx by 5PM on Monday 7th December by email.

                              Further to our recent communications I am prepared to write to the County Court advising them that settlement of my claim has been agreed with the defendant, provided that that you increase your total settlement figure to £2629.04 ( = £2430.30 +8% ) and that from this revised total settlement figure you will deduct the amount required to clear and close my account and then provide me with written confirmation that my account has been closed. I also require the remainder of the settlement proceeds to be transferred via BACS so as to reach my bank account ( sort code xxxxxx, account number xxxxxxxxx, Account name xxxxxxxx ) before close of business on
                              Friday 11th December 2009.

                              Rachel, you are no doubt aware that I am ordered by the Court to submit an Allocation Questionaire by the 11th December 2009. Should you fail to carry out my above requests then I will have no other option than to proceed with submission of the allocation questionaire and proceed with my claim as originally particularised.

                                Budgie that is fab thankyou I will send this email now. however one question,when talking to Anita at cap one, she advised me that tey will not automaticaly close my account or expect me to close it. Also I am aware that I need to build up my credit history with regard to a credit card in the future. Surely keeping the cap one card open and using it only in emmergencies will help me with getting my credit rating up? If I closed it wouldnt it be difficult for me to get a credit card down the line?? Just wondering
